互联网时代的到来不仅为日常通讯带来了便利,也为人们的生活方式开拓了新的格局,直至今天网购成为消费的主要途径之一,它区别于传统的消费方式,网购平台作为一个虚拟的销售平台消费者在购物时处于弱势的一方,对网络产品的感知度与认知度受限,因此对消费者权益的保护就更应得到重视。本文从消费者角度出发分析网络购物中存在的影响消费者权益的行为,主要围绕消费者的隐私权、公平交易权、知情权、求偿权、得不到维护,网购中存在大量虚假信息误导消费者,网络直播带货产品的质量问题以及虚假宣传问题、售后维权等来阐述消费者所处的困境和所面临的问题,在分析思考问题的同时并为此提出几点完善的建议。The advent of the Internet age has not only brought convenience to daily communications but also opened up new horizons for people’s lifestyles. Today, online shopping has become one of the primary means of consumption, distinct from traditional methods. As a virtual sales platform, online shopping places consumers in a relatively weaker position, limiting their perception and understanding of online products. Therefore, the protection of consumer rights becomes even more crucial. This article analyzes behaviors affecting consumer rights in online shopping from the consumer’s perspective, focusing on issues such as the lack of protection for consumers’ privacy rights, fair transaction rights, right to information, and right to compensation;the prevalence of false information that misleads consumers;quality issues and false advertising related to live streaming sales;and after-sales service and rights protection. In analyzing these problems, the article also proposes several suggestions for improvement.
近年来,随着数字经济和互联网经济的高速发展,“数字中国”“网络强国”已经成为我国经济发展的指向标,电子商务已成为现代社会的重要组成部分。电子商务在为消费者带来便利的同时也引发了一系列社会问题。本文旨在研究电子商务环境下消费者权益的保护,分析当前法律实践中存在的挑战和不足。研究发现,电子商务中的消费者权益保护面临诸多问题,如消费者权益保护机制不完善,消费者维权难度大,法律法规和监管体系不健全,电商平台责任落实不到位等问题。尽管已有诸如《消费者权益保护法》和《电子商务法》等相关法律法规,但在实际操作中依然存在诸多法律适用难题。本研究从法学视角出发,对这些法律难题进行分析,并提出一系列改进建议。研究强调,为构建一个更加安全的电子商务环境,必须从立法、执法、司法三条道路进行加强,才能更好促进电子商务市场的健康发展。In recent years, with the rapid development of digital economy and internet economy, “Digital China” and “Network Power” have become the target of our economic development, and e-commerce has become an important part of modern society. While e-commerce brings convenience to consumers, it also causes a series of social problems. The purpose of this paper is to study the protection of consumer’s rights and interests under the e-commerce environment, and to analyze the challenges and deficiencies in the current legal practice. The study found that the protection of consumer rights and interests in e-commerce is faced with many problems, such as imperfect protection mechanism of consumer rights and interests, difficulty of protecting consumer rights, imperfect laws and regulations and supervision system, and e-commerce platform responsibility implementation issues such as not in place. 电子商务是平台经济发展中的中坚力量,随着电子商务等平台企业的不断发展,平台金融化成为一个不可逆转的趋势,金融与平台的不断结合,使金融消费者的权益越来越难以得到保障,信息不对称、数据泄露、监管难等问题不断凸显,制定专门的《金融消费者权益保护法》的呼声也越来越高。平台企业是平台经济的核心,因此电商平台金融化研究要根植于平台经济金融化研究,本文在分析平台金融化的基础上,指出电商平台金融化的风险、金融消费者面临的困境,并进一步提出权益保护的可行性措施,抛砖引玉,以期对进一步加强金融消费者权益保障尽自己的绵薄之力。Electronic commerce stands as the backbone of platform economy development. With the continuous growth of electronic commerce and other platform enterprises, the financialization of platforms has become an irreversible trend. The increasing integration of finance and platforms has made it increasingly difficult to safeguard the rights and interests of financial consumers. Issues such as information asymmetry, data breaches, and regulatory challenges have become increasingly prominent, leading to heightened calls for the formulation of a dedicated “Financial Consumer Rights and Interests Protection Law”. Platform enterprises are the core of the platform economy, thus research on the financialization of e-commerce platforms must be rooted in the study of platform economy financialization. Based on an analysis of platform financialization, this paper points out the risks associated with the financialization of e-commerce platforms and the difficulties faced by financial consumers. Furthermore, it proposes feasible measures for rights protection, aiming to contribute modestly to the enhanced protection of financial consumers’ rights and interests and serving as a catalyst for further discussions.
直播带货作为一种新兴的电商模式,为国内经济的发展注入了新的活力,但是任何事物都具有双面性,直播带货也给消费者带来了维权困难等问题。具体体现为我国目前相关法律法规规定较为滞后,缺乏相应的配套监管制度,尚不能有效地保护消费者在直播带货中的合法权益。健全消费者合法权益的保护才能推动直播带货这个新兴行业的可持续健康发展,因此,健全相关法律制度、加强政府监管和行业自律、提升消费者的维权意识是当下急需解决的重要问题。Live streaming e-commerce, as a new e-commerce model, has injected new vitality into the domestic economy. However, as with any phenomenon, live streaming e-commerce also brings problems for consumers in terms of rights protection. Specifically, the current relevant laws and regulations in China are relatively outdated, lacking corresponding supervisory systems, and are unable to effectively protect the legitimate rights and interests of consumers in live streaming e-commerce. Only by strengthening the protection of consumers’ legitimate rights and interests can live streaming e-commerce, this emerging industry, be sustainably and healthily developed. Therefore, it is an urgent task to establish relevant legal systems, strengthen government supervision and industry self-discipline, and enhance consumers’ rights protection awareness.
在我国经济持续高速、高质量发展的新常态背景下,我国消费者的购买力显著提升,导致大量闲置物品堆积。为了改变资源过度消耗与低效利用的问题,闲置物品通过网络二手交易平台得以流转再利用,实现“物尽其用”的目的。然而,当前网络闲置交易普遍存在缺乏适应性的法律指引及规制、监管机制滞后且可操作性不强、平台责任界定不明及不完善等问题,致使消费者的合法权益遭受侵害。基于此,本文将通过系统性地梳理网络闲置交易中消费者权益保护领域存在的主要问题,深入剖析其背后的原因,有针对性地提出加强消费者权益保护的对策与建议,以此推动网络闲置交易领域的持续、健康发展以及消费者合法权益能够得到全面、有效的维护,最终实现经济效益与社会效益的双赢。Under the new normal background of China’s sustained high-speed and high-quality economic development, the purchasing power of Chinese consumers has significantly increased, leading to the accumulation of a large number of idle items. To address the issues of excessive resource consumption and inefficient utilization, idle items are circulated and reused through online second-hand trading platforms, achieving the goal of “making the best use of everything”. However, current online idle trading is plagued by issues such as the lack of adaptive legal guidance and regulation, a lagging and less operable regulatory mechanism, and unclear and imperfect definitions of platform responsibilities, resulting in the infringement of consumers’ legitimate rights and interests. Based on this, this paper will systematically sort out the main problems existing in the field of consumer rights protection in online idle trading, deeply analyze the underlying causes, and propose targeted countermeasures and suggestions to strengthen consumer rights protection.
