This paper discusses the current situation, development trend, technological innovation and security of enterprise information network payment, and analyzes its impact on enterprise operational efficiency and business model transformation. 传统的缴费与待遇领取方式已难以满足高效、便捷的服务需求,社保网络支付应运而生。但我国社保网络支付正在面临数据安全、跨境支付的法律障碍、反洗钱监管以及用户信任度的巨大挑战,本文通过研究分析国内、国外社保网络支付的实践及其面临的政策环境,取精去糟,得出我国应该建立数据安全机制、加强监管制度建设,完善国内法律法规体系、加强监管制度建设;同时强化宣传教育,加强我国有关社保网络支付的数字技能培训。The traditional way of payment and treatment has been difficult to meet the efficient and convenient service needs, so social security network payment came into being. However, China’s social security network payment is facing a huge challenge of data security, legal barriers to cross-border payment, anti-money laundering supervision and user trust. This article analyzes the practices of domestic and international social security online payments and the policy environments they face, selecting the best and discarding the rest. Based on this analysis, it concludes that China should establish a data security mechanism, strengthen the construction of regulatory systems, improve domestic laws and regulations, and enhance the construction of regulatory frameworks. Additionally, it emphasizes the need to intensify publicity and education efforts, as well as strengthen digital skills training related to social security online payments in China.
第三方网络支付作为我国电子商务领域的主要支付方式,我国相关监管和立法已明显滞后于第三方网络支付的爆炸式增长,笔者认为对第三方网络支付进行法律监管研究具有极大的必要性与急迫性。本文以第三方网络支付的界定为基础,探讨目前我国法律法规对第三方网络支付的监管现状与现行监管体制的不足之处,并对目前监管体制提出制定更高位阶的法律规范、明确沉淀资金孳息的权属以及保障消费者在第三方网络支付中的权益等完善建议,期冀促进网络支付健康发展。Third-party online payment, as the main payment method in China’s e-commerce field, has experienced explosive growth, but the relevant regulation and legislation in China have lagged behind significantly. Therefore, it is of great necessity and urgency to conduct legal regulation research on third-party online payment. Based on the definition of third-party online payment, this paper discusses the current regulatory status and the shortcomings of the current regulatory system regarding third-party online payment in China’s laws and regulations, and puts forward suggestions for improving the current regulatory system, such as formulating higher-level legal norms, clarifying the ownership of accumulated funds’ interest, and safeguarding the rights and interests of consumers in third-party online payment. The aim is to promote the healthy development of online payment.
随着电子金融与电子商务的蓬勃兴起,第三方在线支付已成为当前广泛采用的一种金融交易模式。作为一种新兴的支付手段,第三方在线支付技术日益受到消费者及市场交易的偏爱,构成了“互联网+”时代背景下电子商务的关键要素。鉴于互联网的开放性特征及信息传输的高效特性,第三方在线支付平台若出现故障,极易触发电子商务领域的系统性风险,进而波及国家、社会乃至个人生活的诸多层面。因此,针对第三方在线支付平台所潜藏的风险,构建并实施有效的监管措施,同时健全相应的法律监管框架,显得尤为急迫且重要。本文旨在探讨第三方在线支付监管领域存在的问题,并针对性地提出解决方案。With the vigorous rise of e-finance and e-commerce, the third-party online payment has become a widely adopted financial transaction mode. As an emerging means of payment, the third-party online payment technology is increasingly favored by consumers and market transactions, which constitutes a key element of e-commerce in the context of the “Internet+” era. In view of the open characteristics of the Internet and the efficient characteristics of information transmission, the failure of the third-party online payment platform can easily trigger systemic risks in the field of e-commerce, and then affect many levels of the country, society and even personal life. Therefore, it is particularly urgent and important to construct and implement effective regulatory measures and establish and improve the corresponding legal regulatory framework for the potential risks of the third-party online payment platform. This paper aims to explore the problems existing in the field of third-party online payment supervision, and to propose targeted solutions.
